These Terms explain how you can use Anonime. Please read them carefully before continuing.

1. Introduction

Welcome to Anonime (“we,” “our,” “us”). These Terms of Service (“Terms”) constitute a legally binding agreement between you and Anonime regarding your access to and use of the Anonime.io website and related services (the “Service”). By creating an account, accessing a "Whisper" thread, retrieving a "Private Drop," or using our Service in any capacity, you acknowledge that you have read, understood, and agree to be bound by these Terms. If you do not agree, you must immediately discontinue use of the Service.

2. Description of Service

Anonime provides privacy-focused communication tools designed to protect user identity. The Service includes, but is not limited to:

  • Anonymous Email: The secure sending and receiving of encrypted emails.
  • Whispers: Temporary, anonymous chat threads that expire after a set duration.
  • Private Drop: A secure file and note-sharing utility that utilizes generated codes for retrieval.

Important Legal Disclaimer: We provide privacy and data security; we do not provide immunity from lawful process. We manage the server-side encryption keys to facilitate service delivery, and we are legally required to comply with valid court orders and warrants issued by competent authorities.

3. Eligibility and Guest Users

To use Anonime, you must be at least 16 years old (or the age of digital consent in your jurisdiction) and have the legal authority to enter into these Terms.

Guest Users: Individuals who do not hold an account but interact with the Service (e.g., external users invited to a "Whisper" thread or users retrieving a "Private Drop") are expressly bound by Sections 5 (Acceptable Use), 9 (Intellectual Property), 12 (Limitation of Liability), and 13 (Indemnification) of these Terms regarding their interaction with the Service.

4. Account Registration and Security

Access to certain features requires registering an account using a valid email address via our authentication provider (Google Firebase). You are solely responsible for safeguarding your login credentials and for all activities that occur under your account. You agree to notify us immediately at support@anonime.io of any unauthorized use or security breach. We reserve the right to refuse registration or terminate accounts that violate these Terms or our Privacy Policy.

5. Acceptable Use Policy

You agree strictly not to use the Service (including Emails, Whispers, and Private Drops) for any of the following prohibited activities:

  • Illegal Content: Uploading, sharing, or distributing content that violates Nigerian law or international conventions, including malware, viruses, Child Sexual Abuse Material (CSAM), or illegal contraband.
  • Harassment and Abuse: Using the anonymity features to send threatening, abusive, defamatory, or harassing messages to any individual or entity.
  • Fraud and Deception: engaging in phishing, spamming, impersonating others, or any fraudulent schemes.
  • System Interference: Attempting to reverse engineer the Service, bypass usage limits, disrupt our infrastructure, or launch Denial of Service (DoS) attacks.

Violation of this section will result in immediate termination of your account without notice and, where required by law, reporting of the activity to relevant law enforcement authorities.

6. Subscriptions, Payments, and Taxes

Certain features of the Service may be subject to subscription fees. By subscribing, you agree to the pricing and billing terms displayed at the time of purchase. All fees are non-refundable except where strictly required by applicable law. You are solely responsible for the payment of any applicable taxes, levies, or duties imposed by taxing authorities in your jurisdiction.

7. Data Retention, Volatility, and "Time-To-Live" (TTL)

You expressly acknowledge that Anonime is NOT a permanent storage service. We employ strict "Time-To-Live" (TTL) mechanisms to ensure data minimization:

  • Whispers: Chat threads are automatically and permanently deleted after a maximum duration of 48 hours.
  • Private Drops: Files and notes are deleted immediately upon retrieval ("burn-on-read") or upon expiry of the generated code.
  • Emails: We reserve the right to auto-delete emails and notifications after a set retention period. No Recovery: Once a TTL expires or a Private Drop is retrieved, the data is physically purged from our servers and cannot be recovered by us or you under any circumstances.

8. Data Handling and Privacy

Your use of Anonime is governed by our Privacy Policy, which is incorporated into these Terms by reference. You acknowledge that we do not log IP addresses and that all account data is purged within 30 days of account deletion.

9. Intellectual Property

All content, software, and technology comprising the Service remain the exclusive property of Anonime or its licensors. You are granted a limited, non-exclusive, revocable license to use the Service for lawful personal purposes. You may not copy, modify, distribute, or sell any part of the Service.

10. Termination

We reserve the right to suspend or terminate your account (or block Guest access) at our sole discretion, without prior notice, if you breach these Terms, if your activity poses a security risk to the system, or if we are required to do so by law. Upon termination, your data will be deleted in accordance with our Privacy Policy.

11. Disclaimer of Warranties

THE SERVICE IS PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS. WE EXPRESSLY DISCLAIM ALL WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT GUARANTEE THAT THE SERVICE WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE, NOR DO WE GUARANTEE DATA PERMANENCE OR ABSOLUTE ANONYMITY.

12. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, ANONIME, ITS AFFILIATES, OFFICERS, EMPLOYEES, AGENTS, AND PARTNERS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION, LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM (i) YOUR ACCESS TO OR USE OF OR INABILITY TO ACCESS OR USE THE SERVICE; (ii) ANY CONDUCT OR CONTENT OF ANY THIRD PARTY ON THE SERVICE; OR (iii) UNAUTHORIZED ACCESS, USE, OR ALTERATION OF YOUR TRANSMISSIONS OR CONTENT. IN NO EVENT SHALL OUR TOTAL LIABILITY EXCEED THE GREATER OF USD $10 OR THE AMOUNT YOU PAID US, IF ANY, IN THE PAST TWELVE MONTHS.

13. Indemnification

You agree to defend, indemnify, and hold harmless Anonime, its affiliates, directors, officers, and employees from and against any and all claims, damages, obligations, losses, liabilities, costs, and expenses (including but not limited to attorney's fees) arising from: (a) your use of and access to the Service; (b) your violation of any term of these Terms; (c) your violation of any third-party right, including without limitation any copyright, property, or privacy right; or (d) any claim that your content (including Private Drops or Whispers) caused damage to a third party.

14. Dispute Resolution

a. Mandatory Arbitration

All disputes arising out of or relating to these Terms or the Service shall be resolved through binding arbitration.

b. Class Action Waiver

You agree that any arbitration or proceeding shall be limited to the dispute between us and you individually. To the full extent permitted by law, (i) no arbitration or proceeding shall be joined with any other; (ii) there is no right or authority for any dispute to be arbitrated or resolved on a class action-basis or to utilize class action procedures.

15. Governing Law and Jurisdiction

a. Governing Law

These Terms are governed by the laws of the Federal Republic of Nigeria.

b. International Consumers

If you are a consumer residing in the EU, UK, or other jurisdictions with mandatory consumer protection laws, this governing law clause does not deprive you of the protection afforded to you by the mandatory provisions of the law of your country of residence.

c. Dispute Resolution

Any disputes shall be resolved primarily through binding arbitration in Nigeria. However, we encourage you to contact support@anonime.io first to resolve issues informally.
